GENERAL TERMS AND CONDITIONS OF SALE
Article 1 – Introduction
TTT Société de Transport en Commun par Train Touristique (hereinafter referred to as "Le Petit Train de Bastia" or "the Company") is a company offering guided tours of the city of Bastia on a small tourist train. The present general terms and conditions of sale (GTC) govern the relationship between the Company and its customers.
Article 2 – Définitions
- Customer: any natural or legal person purchasing tickets for the tourist train rides.
- Ticket : title giving the right to a place on board the little train for a ride.
- Driver: employee of the Company driving the small train.
Article 3 – Objet
The purpose of these GTC is to define the conditions under which tickets are sold and services are provided by the Company. They apply to all ticket sales and services provided by the Company, whether at the Bastia tourist office or directly with the driver.
Article 4 – Price
The prices of the small train rides are fixed according to the categories of tickets (adults, children and groups) and the possible reductions granted. Prices are indicated in euros, all taxes included, and are subject to change at any time. The schedules and rates are mentioned on the Company's website.
Article 5 - Reservation terms and conditions
Tickets can be reserved and purchased at the Bastia tourist office or directly from the driver of the little train. Reservations are subject to availability. Groups are defined as a minimum of 10 people.
Article 6 - Terms of payment
Payments can be made in cash or by check to the driver, and by credit card at the tourist office of Bastia, subject to acceptance by the Company.
Article 7 - Issue of tickets
Tickets are issued in paper form only. The ticket must be presented to the driver before boarding the train.
Article 8 - Modification and cancellation
Clients may modify or cancel their reservation up to 48 hours before departure, subject to availability. After this time, no refund or exchange will be possible.
Article 9 - Refunds
In the event of cancellation by the Client under the conditions provided for in Article 8, the Company will refund the amount of the tickets, excluding any administration fees. Tickets purchased at the tourist office will be refunded at the tourist office, and those purchased from the driver will be refunded by the driver. In case of cancellation or modification by the Company, the Customer will be fully refunded.
Article 10 - Schedules and itineraries
The schedules and itineraries of the small train rides are available on the Company's website. Departures are guaranteed from 4 passengers. If less than 4 passengers are present, the departure is cancelled. The Company reserves the right to modify the schedules and itineraries in case of necessity or for reasons beyond its control, without this giving rise to any compensation or refund.
Article 11 - Responsibilities and insurance
The Company is responsible for the proper performance of the services provided in accordance with these T&Cs. The Company is covered by professional liability insurance. The Client is responsible for its own safety and that of the persons accompanying it. The Client is required to comply with the safety instructions given by the Company and the Driver.
Article 12 - Access and security conditions
Customers must comply with the safety rules and the Driver's instructions on board the train. Children under the age of 12 must be accompanied by an adult. Pets are allowed on the train, provided they are kept on a leash and do not cause a nuisance to other passengers. Bulky luggage and dangerous objects are not allowed.
Article 13 - Lost and Found
Items found on board the little train must be given to the Driver or to the Bastia Tourist Office. The objects can be recovered by their owners on presentation of an identity card.
Article 14 - Complaints
Any complaint relating to a service provided by the Company must be sent by registered mail with acknowledgement of receipt to the Company's address or by e-mail to the e-mail address indicated on the Company's website, within 30 days of the date of the service concerned.
Article 15 - Protection of personal data
The Company collects and processes the personal data of the Clients in compliance with the regulations in force. The data is used to manage reservations, issue tickets and provide services. Clients have the right to access, rectify, delete and oppose their data for legitimate reasons, which they may exercise by contacting the Company.
Article 16 - Intellectual Property
The trademarks, logos, texts, images and other contents of the Company are protected by intellectual property law. Any reproduction, representation or use without prior authorization from the Company is prohibited.
Article 17 - Applicable law and competent jurisdiction
The present GTC are governed by French law. In the event of a dispute, the parties shall endeavor to find an amicable solution. Failing that, the French courts will have exclusive jurisdiction to settle the dispute.
Article 18 - Modification of the general conditions of sale
The Company reserves the right to modify these GTC at any time. The modifications will come into effect as soon as they are published on the Company's website and will apply to reservations made after this publication. Clients are invited to regularly consult the GTC in order to take note of any changes.
Article 19 - Final Provisions
If any provision of these GTC is found to be invalid, it shall be deemed unwritten, without invalidating the other provisions. The non-exercise by one of the parties of its rights resulting from the present GTC shall not be interpreted as a waiver to assert these rights later.
